These Terms of Use (“Terms”) are a legal agreement between you and Dany Oudeesh for your use of the game Sky Hop (the “App” or “Game”), including any updates and related documentation.
By downloading, installing, or playing Sky Hop, you agree to these Terms and to the Privacy Policy at https://dannymac1992dm-tech.github.io/sky-hop/privacy.html. If you do not agree, do not use the App.
If you are under the age of majority where you live, you may use the App only with permission of a parent or legal guardian who agrees to these Terms on your behalf.
Sky Hop is an original flap-style skill game built with HTML5 Canvas and JavaScript/CSS, intended for free download. Monetization may include advertisements (for example Google AdMob or similar) after packaging for app stores such as Google Play (Android first), and possibly other platforms later.
Sky Hop uses original name, art, and sound. It is not affiliated with, endorsed by, or connected to Flappy Bird or its rights holders, and it does not use Flappy Bird branding or assets.
Subject to these Terms, Dany Oudeesh grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and play Sky Hop on devices you own or control, solely for your personal, non-commercial entertainment.

Sky Hop — including its name, game design as expressed in the App, original visual art, audio/sound design, user interface, and code as published — is owned by Dany Oudeesh, except for third-party components (open-source libraries, platform SDKs, ad SDKs, fonts, or tools) which remain owned by their respective owners and are used under their licenses.
Playing the Game does not transfer ownership of any IP to you. Feedback you send (ideas, suggestions, bug reports) may be used by the publisher without obligation to compensate you, unless a separate written agreement says otherwise.
Sky Hop is offered as a free download. The publisher may display advertisements, including through Google AdMob or similar networks. Ads may appear on menus, game-over screens, or other placements described in store materials or in-App.
You agree that:
Optional features such as rewarded ads (for example an optional continue) may be offered; they are not required to install the App.
In-app purchases are not part of the current plan unless later disclosed in the store listing and these Terms are updated.
Sky Hop does not require user accounts or login for core play. The App may store limited data on your device (for example high score and mute preference). See the Privacy Policy for details. Clearing App storage or uninstalling may erase local progress.
You agree not to use Sky Hop to:
Violation may result in termination of your license and, where applicable, reporting to platforms or authorities.
If you download Sky Hop from Google Play, the Apple App Store, or another store, that store’s terms also apply. The store provider is not a party to these Terms as the publisher of Sky Hop, except as required by store rules (for example Apple’s standard EULA language for apps distributed on the App Store, if applicable).
Third-party SDKs (ads, analytics if later added, crash reporting if later added) are governed by their own terms.
We may update, patch, suspend, or discontinue Sky Hop (or features, levels, or ads) at any time. We may also update these Terms. The Effective date will change when Terms are updated. Continued use after changes constitutes acceptance where permitted by law. If you do not agree to updated Terms, stop using the App and uninstall it.
Your license ends automatically if you breach these Terms. You may stop using Sky Hop at any time by uninstalling it. Sections that by nature should survive (including IP ownership, disclaimers, limitation of liability, and governing law) survive termination.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKY HOP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, secure, or compatible with every device, or that scores, ads, or local data will never be lost.
Some jurisdictions do not allow certain warranty exclusions; in those places, exclusions apply only to the extent allowed.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DANY OUDEESH WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF (OR INABILITY TO USE) SKY HOP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US FOR THE APP IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (WHICH IS ZERO FOR A FREE APP WITH NO PAID FEATURES), OR (B) FIFTY U.S. DOLLARS (USD $50).
Nothing in these Terms excludes liability that cannot be excluded under applicable law (for example certain personal injury or fraud claims where prohibition is mandatory).
To the extent permitted by law, you agree to defend and indemnify Dany Oudeesh against claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the App or your breach of these Terms.
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-law rules that would apply another jurisdiction’s laws.
The state and federal courts located in the State of Michigan, USA will have exclusive jurisdiction over disputes, except that we may seek injunctive relief in any jurisdiction to protect IP, and except where consumer-protection law gives you a mandatory right to bring claims in your home courts.
You must comply with applicable export controls and with Google Play / other store policies when using or redistributing builds you are not authorized to distribute.
